GENERAL TERMS AND CONDITIONS

 • Booking Confirmation: The guest must provide a valid form of identification and pay the full amount due to confirm the booking. The booking confirmation is subject to availability and our approval. Security Deposit: A security deposit is required for each stay. The deposit amount varies based on the property and will be communicated to the guest before confirmation.

• Check-In/Check-Out. Check-in time is [3 PM] on the first day of the rental term, and check-out time is [11 AM] on the last day of the rental term. Early check-in and late check-out may be available upon request and subject to availability.

• Cancellation by the guest: i. ​Guests who cancel their booking 7 days or more before check-in shall be entitled to a 50% refund of any amount paid, including any applicable Oraya Holiday Homes L.L.C or third-party service fee. ii. Guests who cancel their booking less than 7 days before check-in will be charged the value of the total nights, less all fees and charges associated with the original value of their booking. iii. ​In case of extreme and/or exceptional circumstances such as but not limited to Natural disasters, death or injury, the cancelation policy will not apply and a full refund will be provided to the guests. iv. It is crucial for guests to be aware that cancellation initiated by them may result in the forfeiture of the security deposit, as specified in the terms and conditions of the agreement. Any such forfeitures will be communicated clearly in the cancellation notice provided to the guest. Cancellation by Oraya Holiday Homes L.L.C: I. Change in Property Management: In the event that the property is no longer managed by Oraya Holiday Homes, and the owner terminates their contract with us, resulting in the cancellation of the booking, the guest will not forfeit their security deposit. Every effort will be made to provide alternative accommodation or a full refund. II. ​Force Majeure: In cases of force majeure events where circumstances beyond our control affect the property's availability or safety, leading to booking cancellation, the security deposit will not be forfeited. Guests will be promptly informed, and suitable alternatives or refunds will be offered. III. ​Non-Compliance with Terms: If guests fail to comply with the terms and conditions outlined in the agreement, leading to booking cancellation, the security deposit may be forfeited. Notice will be given, allowing the guest an opportunity to rectify any issues before cancellation is finalized. IV. ​Payment Default: In the case of non-payment or default on payment obligations by the guest, resulting in booking cancellation, the security deposit may be forfeited. Notice will be provided, allowing the guest an opportunity to rectify the payment issue before cancellation is finalized.

• Substantial Property Damage: If the guest causes significant damage to the property during the stay, leading to booking cancellation, the security deposit may be forfeited. The guest will be held responsible for any damages incurred. V. False Information: If it is discovered that the guest provided false information during the booking process, leading to misrepresentation of their identity or intentions, resulting in booking cancellation, the security deposit may be forfeited. VI. ​Violation of Property Policies: Guests who repeatedly violate property policies, leading to disturbances or inconveniences for other residents or neighbours, and subsequent booking cancellation may forfeit the security deposit. VII. It is crucial for guests to be aware that cancellation initiated by them may result in the forfeiture of the security deposit, as specified in the terms and conditions of the agreement. Any such forfeitures will be communicated clearly in the cancellation notice provided to the guest. Occupancy Limits: Guests must not exceed the maximum occupancy stated in the booking confirmation. Violation of this rule may result in eviction from the property without any refund. Vehicles: Guests will be informed of the parking availability for each property. The number of permitted vehicles and designated parking slots vary based on the property.

• Use of Property: The holiday rentals are strictly for residential purposes only. The guest is not allowed to use the property for any commercial or unlawful activities. • Smoking Policy: Smoking is strictly prohibited inside the holiday rentals. Violation of this rule may result in a penalty charge of AED 1000.

• Pets Policy: Pets are not allowed inside the holiday rentals without our prior approval. If you decide to bring a small dog, there will be an extra charge of AED 1800. This fee covers the cost of deep cleaning the entire unit, including carpets and couches.

Damages and Breakages: The guest is responsible for promptly reporting any damages, breakages, or stains on furniture, the property, linens, walls, or couches during their stay. All damages or stains caused by the guest must be reported immediately. The guest acknowledges that damages or stains attributable to their actions may result in deductions from the security deposit to cover the costs of repairs, replacements, or professional cleaning. It is essential for the guest to communicate any such incidents without delay to facilitate timely resolution and ensure the maintenance of a well-cared-for accommodation.

• Noise and Disturbance: The guest must maintain a peaceful and quiet environment and avoid creating any noise or disturbance that may cause inconvenience to other guests or neighbours. Violation of this rule may result in eviction from the property without any refund. Guests are responsible for the behaviour of their visitors as well.

• Property Modification and Maintenance: The guest is not permitted to make any modifications to the apartment without written consent from the company, including painting or furniture rearrangement. In case of maintenance issues, the guest must promptly report them to the company and refrain from attempting independent repairs. The company will arrange for qualified personnel to address any necessary repairs, ensuring the property's integrity and functionality. It is important to note that any maintenance related damages during the guest’s stay will be invoiced to the guest. Violation of this clause may result in additional charges or termination of the agreement.

• Cleaning and Housekeeping: The holiday rentals are cleaned before and after every guest’s stay. Housekeeping services are available upon request and are subject to additional charges.

• Keys and access cards: will be issued to the guest for the agreement period. Any loss or damage of the keys and cards will be paid by the guest.

• Liability: We shall not be liable for any loss, damage, or injury caused to the guest or their property during their stay at the holiday rentals.

• The guest agrees to sign and adhere to the Community Rules (Building Specific). Available on Request.

• Governing Law: This agreement, including all its terms and conditions, is subject to the governing laws of the United Arab Emirates. All interpretations, legal actions, or disputes arising from or in connection with this agreement shall be construed in accordance with the applicable laws of the United Arab Emirates.
